Delivery & Payment

The prices include VAT.
If there are more than 6 months between the conclusion of the contract and the agreed and / or actual delivery date, the prices of the seller valid at the time of delivery or provision apply. If the latter prices exceed the initially agreed prices by more than 10%, the customer is entitled to withdraw from the contract. Discounts cannot be combined.

Delivery times:
Delivery dates or deadlines that can be agreed as binding or non-binding must be in writing. Section 2.3 applies. In the event of delivery delays for which GladiatorPLUS AG is responsible, the duration of the grace period legally set by the customer is set at 2 weeks, which begins when we set the grace period.

Shipping & transfer of risk:
The risk passes to the customer as soon as the consignment has been handed over to the person performing the transport. If shipping is delayed at the request of the customer, the risk passes to the customer when the readiness for shipping is reported. This also applies if the goods are shipped from a location other than the place of business.
Deliveries are only insured in his name and on his account at the express request of the customer.

Payment:
GladiatorPLUS AG expressly reserves the right to refuse checks or bills of exchange. Acceptance is always only as payment. Discount and bill charges are charged to the customer and are due immediately. We are entitled to credit payments against older debts, despite the customer's provisions to the contrary, and we will inform the customer of the type of settlement made. If costs and interest have already arisen, we are entitled to offset the payment first against the costs, then against the interest and finally against the main claim. The customer is only entitled to offset if the counterclaim is justified and undisputed. For delivery on account, payments must be made net within 30 days of our availability.

Payment with credit card:
Please keep the order confirmation, which you have printed out, received by email or post, easily accessible. Your credit card will be charged when the goods are shipped in full.
